What is the federal 120-day rule for mortgages?

A federal mortgage-servicing rule, 12 CFR 1024.41(f)(1), sets a waiting period before foreclosure can begin. A servicer generally may not make the first notice or filing required for foreclosure until the borrower is more than 120 days delinquent. There are exceptions, for example when the loan is in default because of a due-on-sale violation.

For date-counting, the phrase that matters is "more than 120 days." Day 120 itself does not satisfy it. The first day that does is day 121. So if you are tracking this rule, the date in the answer box is the last day before the threshold, not the threshold.

Why does four months not equal 120 days?
